On Sunday, Marshall County Police arrested a Minnesota man for Operating While Intoxicated (OWI) with a Blood Alcohol Content (BAC) over three times the legal limit.

Officials said a 911 caller told Marshall County Central Dispatch that the man was attempting to drive along U.S. Route 30, but was weaving excessively and unable to maintain speed.

Police stopped the driver and transported him to Plymouth Hospital for a chemical test for alcohol consumption. After he was determined to be three times over the legal limit, he was taken to Marshall County Jail and charged with a Class A Misdemeanor OWI, and issued a $1,505 bond.

A Minnesota resident arrested in Indiana for OWI with such an elevated BAC may face serious consequences. A Class A Misdemeanor carries penalties of up to one year in jail, fines up to $5,000, license suspension of up to one year, and other administrative penalties, such as alcohol counseling.

Although Indiana cannot directly suspend an out-of-state license before conviction, it can revoke an individual’s driving privileges within the state and report the suspension to the Minnesota Department of Public Safety, which typically honors the suspension under the Driver License Compact. As a result, the individual may also face a suspension or other administrative penalties in Minnesota.
